Time to prepare for the Holidays!

Halloween, Thanksgiving, Thanksgiving Weekend, Christmas Eve, Christmas Day, Winter Break…they’re  right around the corner! Most marital settlement agreements have specific provisions for parenting time or visitation during the holidays.  The most common provisions have divorced spouses alternating the holidays year-by-year, or taking portions of the day on each holiday.  Now is the ideal time to revisit your Judgment for Dissolution of Marriage/Marital Settlement Agreement/Joint Parenting Agreement and make sure that your plans this year conform to the provisions included in your divorce decree.  If you and your ex want to deviate from the provisions in your divorce decree, it is best to contact your divorce attorney and enter an agreed order with the court making the change official.  Stories abound of divorced couples who “agreed” to do something other than what was in their divorce decree, only to have the police called on Christmas morning when one ex-spouse changes their mind.  Agreements made outside of court are not enforceable.  Make sure that your plans are set, your schedule approved by the court, and your holidays stress-free.  The attorneys at Sullivan Taylor & Gumina, P.C. can help you make the holidays a time of happiness and cherished memories.  If you need help getting a change to your parenting time or visitation, please contact the attorneys at Sullivan Taylor and Gumina, P.C. today!
